POLICIES
Renters agree to follow all policies.
Security Deposit
In addition to the rental fees, a $300 security deposit will be added to your total charge at checkout. Reservation must be paid in full to confirm your reservation. The $300 security deposit will be refunded within ten business days after the event provided the cleaning protocols are complete and premise is vacated by 11 PM.
Permitted Use
The Renter shall not exceed the maximum occupancy limits and agrees to comply with all applicable laws, ordinances, park rules, and public health guidelines.
Use of the Premises for any unlawful, hazardous, disruptive, or otherwise inappropriate purpose shall result in immediate termination of this Agreement and forfeiture of all fees and deposits.

Damages & Charges
SHPA will inspect the Premises post-rental and reserves the right to deduct any cleaning fees or repair costs from the security deposit. Renter agrees to pay all damage or cleaning charges exceeding the security deposit within ten calendar days of receipt of notification from SHPA.

Liability & Indemnification
Renter shall indemnify, defend, and hold harmless SHPA, its officers, directors, employees, agents, and volunteers from and against all claims, liabilities, losses, damages, expenses, and attorney fees arising from or related to Renter’s use of the Premises or any breach of this Agreement. Renter assumes full liability for injury, damage, loss, or claims resulting from activities conducted on the Premises by Renter or any guests, invitees, agents, or contractors.
Restrictions
Violation of any restrictions below will result in forfeiture of the security deposit.
This is a non-exhaustive list:

No alcohol allowed on the Premises.

Smoking or vaping is strictly prohibited.

No confetti or glitter permitted.

Fireworks are strictly prohibited.

Bounce houses, tents, waterslides, carpets, or other materials may not be placed on the grass.

Do NOT move or attempt to move the large stone table in the lobby; the top is heavy, unattached, and presents safety risks.

Decorations allowed only with painter's tape, ribbon, string, or wire attached to existing nails and hooks.

Children must be supervised at all times.
Security Deposit & Cleaning Requirements
Renter must clean the Premises thoroughly and vacate no later than 11:00 PM. The $300 security deposit will be refunded within ten business days after the event provided the following tasks are completed:

Sweep floors.

Mop up spills; empty mop buckets outside.

Remove all decorations.
-
Wipe down kitchen counters, sinks, and clean appliances used.

Dispose of garbage in outside trash containers.

Remove litter from outdoor grounds and parking areas.

Stack chairs neatly in the South room.
-
Carefully clean and store tables without damage.

Turn off lights and close all windows.
-
Lock all doors securely, ensuring the front door latches properly.

Remove all personal belongings. SHPA is not responsible for items left behind.
Failure to complete these tasks, and anything else necessary to return the Premises to a clean condition, will result in forfeiture of the security deposit.
Insurance
At SHPA's sole discretion, Renter may be required to provide proof of liability insurance in an amount deemed sufficient by SHPA and naming SHPA as an additional insured. Failure to provide required insurance shall result in immediate cancellation without refund.
Cancellation Policy
Cancellations must be completed at least 72 hours prior to the start of the rental period. Refunds will adhere to SHPA’s cancellation policy as provided upon reservation. SHPA is not responsible for cancellations due to circumstances beyond its control (e.g., natural disasters, utility disruptions, governmental action).
Attorney's Fees
In the event SHPA is required to take legal action or engage in dispute resolution (including but not limited to collection efforts) to enforce any term or condition of this Agreement, SHPA shall be entitled to recover from Renter all costs and expenses incurred, including reasonable attorney fees, court costs, collection agency fees, and all other related expenses, whether incurred before, during, or after litigation, arbitration, or appeal. This provision shall survive the expiration or termination of this Agreement.
Governing Law
This Agreement shall be governed by Utah law. Any legal actions arising from or relating to this Agreement shall be adjudicated exclusively in courts within Salt Lake County, Utah and the undersigned parties irrevocably consent to the jurisdiction of such courts for the purposes of this Agreement.
Right of Entry
SHPA reserves the right to enter the Premises at any time during the rental period, with or without prior notice to Renter, for the purpose of inspection, maintenance, enforcement of the terms of this Agreement, or in the event of an emergency. Renter shall not obstruct or restrict SHPA representatives or contractors from accessing the Premises.
Non-Waiver
No failure or delay by SHPA in enforcing any right, term, or provision of this Agreement shall be deemed a waiver of such right or provision. Waiver of any breach of this Agreement shall not constitute a waiver of any subsequent breach.
Force Majeure
SHPA shall not be liable or responsible to Renter, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in the performance of its obligations under this Agreement when such failure or delay is caused by or results from events or circumstances beyond the reasonable control of SHPA. These events include, but are not limited to: acts of God; natural disasters; pandemics, epidemics, or public health emergencies; flood; fire; earthquake; explosion; utility service interruption or failure; acts of terrorism or war (declared or undeclared); riot or civil unrest; governmental action or regulation; labor disputes, strikes, or lockouts; embargoes; supply chain disruptions; cyberattacks; or the failure of any third party to perform any obligations necessary to the execution of this Agreement. In such cases, SHPA shall be excused from performance for the duration of the delay or inability to perform, and Renter shall not be entitled to any refund, credit, or compensation of any kind due to such nonperformance.
